London Fischer LLP congratulates Christian Villani and Brian A. Kalman on their victory in the case Wade v. Levister Redevelopment Company LLC, et al., a case venued in the Supreme Court of the State of New York, Westchester County. The trial Court dismissed all of Defendants/Third-Party Plaintiffs’ claims against London Fischer’s client, an elevator contractor and granted their request for indemnification inclusive of reimbursement of defense costs.
London Fischer LLP established through uncontroverted testimony that the alleged dangerous condition the Plaintiff encountered was outside the scope of the elevator contractor’s limited scope of work at the premises. To bolster this position, London Fischer LLP also established, through records and an expert opinion, that upon the elevator’s last inspection, which critically occurred on the date of the incident, the elevator’s mechanical and electrical components were in safe working order.
