Notable Decisions/Results

Mr. Kranzler successfully defended a homeowners insurance carrier on a claim of windstorm damages in Martin County. In advance of trial, he obtained partial summary judgment on the issue of late notice, establishing a presumption of prejudice going into trial. He further obtained a key admission from the plaintiff’s expert, receding from his own key opinion. At trial, he successfully argued for a directed verdict on the issue of prejudice, obtaining final judgment on behalf of his client.

Mr. Kranzler also successfully defended a homeowners insurance carrier on a claim of a bathtub overflow. During discovery, he obtained testimony from the insureds evidencing a lack of ensuing damages, and prevailed in preventing opposing counsel from unilaterally changing his clients’ testimony. Once the summary judgment motion was filed and set for hearing, the plaintiffs attempted to dismiss and refile their lawsuit, and Mr. Kranzler successfully obtained an order of final judgment which struck the voluntary dismissal and awarded final judgment in favor of his client. Mr. Kranzler authored the opinion which the trial court adopted in full, and which was affirmed, per curiam, by the Fourth District Court of Appeal.
