Bob Martin is an experienced attorney who has successfully litigated matters in the fields of construction and labor law, premises liability, toxic tort, sexual abuse, products liability, medical malpractice and others from inception through trial and appeal for over 30 years.  He brings an aggressive can-do attitude coupled with broad experience to maximize results for the client.

Over more than three decades of practice, Mr. Martin has taken over thirty cases to trial in Federal and State Courts.  Mr. Martin successfully defended the State of New York before the Court of Claims in a matter significant physical injury and traumatic brain injury by a police office who was struck by debris.  The Court found no liability.  He also secured a verdict of no damages in a libel, slander and breach of contract five-week trial against a clinic in the Bronx where the plaintiff demanded $9,000,000 damages and the court charged punitive damages.  This was a damages only trial as summary judgment was found in favor of plaintiff before trial

Prior to joining London Fischer LLP. Mr. Martin was Senior  Litigation Counsel –Trial Attorney for a major insurance carrier where he specialized in medical malpractice, dental malpractice, and allied healthcare professional defense.  Previously, he was a partner at a New York area defense firm where he specialized in trial and defense of labor law, medical malpractice (individual physician, multi-specialty group, hospital, and nursing home), architectural malpractice, products liability, and construction site, premises, fraud, libel and breach of contract actions through all phases from pleadings through discovery and trial in State and Federal courts; preparation and argument of appeals; participation in mediations and arbitrations; and preparation of and delivery of presentations to clients.

Mr. Martin is a member of the Legal Advisory Board for the Lawsuit Reform Alliance of New York.

He is a two-time Past president and co-chair for Public Relations and Membership of the Association for Healthcare Risk Management of New York, Inc., the New York chapter for the American Society for Healthcare Risk Management.  He is a regular speaker on subjects involving regulation and legislation affecting the healthcare risk management community.

Notable Decisions

Mr. Martin led a team of attorneys that successfully defended the crane manufacturer in a multi-plaintiff multi-defendant tower crane collapse accident involving over 20 lawsuits and a value placed by the judge on the case of $269,000,000 in personal injury and property damages.  The actions were ultimately settled with modest contribution on behalf of the client.

Mr. Martin successfully drafted and argued numerous summary judgment involving Labor Law, premises liability, medical malpractice and indemnification.  This included a motion for summary judgment on behalf of a contractor for a post Superstorm Sandy rehabilitation project where the plainti

ff fell approximately 28 feet down into a manhole while inspecting for asbestos prior to commencement of the work.  The decision was affirmed on appeal. 

Mr. Martin obtained pre-answer dismissal of an action brought under the Gender -Motivated Violence Act against a major religious education school in Brooklyn. He also obtained summary judgment in favor of an electrical contractor in a matter involving a fall of 28 feet in a manhole utilizing the asbestos inspection exception to labor law liability in New York County.  This was sustained on appeal.
