COMMERCIAL LITIGATION PRACTICE

London Fischer LLP and its attorneys represent clients in numerous commercial disputes in federal and state courts, arbitration and mediation, including the Commercial Division of the Supreme Court of the State of New York, the United States District Courts for the Eastern and Southern Districts of New York, other State and Federal courts and the American Arbitration Association. The commercial disputes handled by London Fischer involve an array of subjects including contracts, commercial tenancy, public bid disputes, commercial guarantees and rights in intellectual property, with issues ranging from adjustment of the total loss of an oceangoing oil rig, to injunction on payment under a letter of credit, to the terms of an alleged oral finder's agreement, to the alleged infringement upon the copyright in a well known children's cartoon character.

The following matters are illustrative of our representation of clients as plaintiffs and defendants in a wide range of commercial disputes:

We successfully defended a prominent contractor in the construction industry against a broker's claim for finder fees for allegedly assisting the contractor in securing construction contracts based upon an alleged oral agreement between the two parties.

We have successfully defended our client in numerous lawsuits arising out of our client's issuance of a performance bond to various entities owned by a common principal. This principal used the bond and altered consents to surety provided by our client in order to perpetrate a massive fraud upon third parties by making it appear that the bond ensured payment of notes issued by the principal's entities. Numerous lawsuits have been instituted throughout the United States against our client by the parties that purchased these notes from the common principal's entities, but so far, we have been able to have our client dismissed from each of these cases.

We are presently defending a client against a claim for breach of its guarantee of payments due by our client's subsidiaries under commercial lease agreements for the leasing of trucks.

The ability of our attorneys to successfully negotiate the transfer and assignment of various proprietary interests and breeding rights in the renowned racehorse Cigar facilitated the settlement by insurers of a thirty million dollar claim for the horse's commercial failure as a stallion.

Our attorneys successfully defeated a real estate developer's attempt to rescind a multi-million dollar contract to purchase the Park Row properties in New York City.

We are presently defending an international insurance broker in highly publicized film finance commercial litigation. In the first two (2) cases decided thus far, we have secured the dismissal of our client from claims that insurers were fraudulently induced into entering into contracts of insurance which served as collateral security for multi-million dollar loans made by bank syndicates to major motion picture studios to finance the production of feature length films.
